• Today, President Biden announced that the Department of Homeland Security will take action to ensure that American citizens with non-citizen spouses and children can keep their families together.

• This new process will help certain non-citizen spouses and children apply for lawful permanent residence – a status they already qualify for – without leaving the country.

• These actions will promote family unity and strengthen our economy, providing a significant benefit to the country and helping American citizens and their non-resident family members stay together.

• To qualify, non-citizens must – as of June 17, 2024 – have lived in the United States for 10 years or more and be legally married to a U.S. citizen while meeting all applicable legal requirements. On average, those eligible for this process have lived in the US for 23 years.

• Those who are approved after DHS’s individual application review will be given a three-year period to apply for permanent residency. They can stay with their families in the United States and are eligible for a work permit for up to three years. This applies to all eligible married couples.

• This action will protect approximately half a million spouses of U.S. citizens and approximately 50,000 noncitizen children under the age of 21 whose parents are married to a U.S. citizen.
