Carol Burnetts daughter Erin Hamilton asked the court to resume visitation with her son after several months without communication due to a court order.

This is evident from court documents obtained by RadarOnline.comthe comedian’s daughter begged the judge to reconsider his decision to block contact until the next hearing in September 2024.

Carol’s daughter says she is sober now.

As we first reported, in 2020, Carol and her husband Brian Miller filed to be appointed co-guardians of Erin’s son Dylan. The entertainer said her daughter had struggled with addiction for years and was recently placed in a 5150 hold.

“Over the past 19 years, Erin has been in and out of rehabilitation centers and has been institutionalized a total of eight times for a minimum of 30 days,” Carol said in court.

Carol said that Dylan’s father was not fit to care for him. As a result, the court appointed Carol and Brian as co-guardians until they found a permanent replacement.

The couple eventually nominated a third party named Jodi Pais Montgomery to take over as curator. Jodi previously served as Britney Spears’ co-conservator during her controversial conservatorship.

Carol said her daughter was unable to raise her child.

As part of the custody arrangement, Erin was given visitation with strict rules. She was allowed to see Dylan for two hours once a week. A few months later, Erin was accused of breaking the rules by visiting her son while his father had visitors.

Erin claimed she “ran into” her ex and son – and never intended to violate the court order. Dylan’s court-appointed attorney asked to suspend Erin’s visit due to her “erratic” behavior. The attorney requested a court order for Erin to submit to random drug testing.

As we first reported, Erin told RadarOnline.com earlier this year that she is currently sober and wants her son back. A hearing to reinstate Erin’s visitation has been repeatedly continued by the court.

It was recently moved from March to July and then to September. Erin’s attorney said that by September, she “will not have any visitation with her son for a year.”

Carol has yet to respond to Erin’s plea.

Erin said Dylan will graduate from high school in May.

Her lawyer explained: “The visits previously ordered by the Court took place remotely with a monitor. There was no evidence of any significant problem with the monitored visits. There was an incident where Mrs. Hamilton reportedly saw her son and his father in a public place. It was also alleged that Ms Hamilton continued her drinking and substance abuse. The Court went ahead and stopped all visits pending the evidentiary hearing. Now that hearing has been rescheduled for the third time.”

He added: “The evidentiary hearing has now been rescheduled for September 2024. The minor child will graduate in May and, according to the court and other parties, there is no availability for a hearing before September. Indeed, the inability to visit a child or attend a major life event due to court delays on a hearing date set for January 2024 is harm that cannot be remedied.”

Erin’s attorney said: “There was no evidence of any danger to the child presented that would be resolved by banning the supervised, remote visits, namely Zoom visits. Moreover, suspending all contact for a year is both draconian and punitive. The hearing at which the order was issued to end all visitation wasn’t even a hearing on the issue of visitation – it was a hearing on the annual status report. The controlled remote visits showed no danger whatsoever. Accordingly, it is appropriate and the right thing to do to reinstate Mrs. Hamilton’s supervised visits and allow her to attend her son’s graduation ceremony in May.

Erin wrote, “I’m hardly a danger to my child.”

In a statement, Erin wrote: “I am hardly a danger to my child. I have been consistently tested for drugs and alcohol since returning from Hawaii and I work with people in treatment and I have to stay completely sober to keep my job. I love my job and I love being sober.”

A judge has yet to make a ruling.
