Denver Nuggets fan sues Kroenke after bathroom attack at Ball Arena

A Denver Nuggets fan is suing the owner of Ball Arena Kroenke Sports & Entertainment And Argus events staff for not hiring enough female security guards after she was attacked in a bathroom during a 2023 playoff game against the Los Angeles Lakers.

Denver resident Kathy Kim claims she was attacked by two women who thought she was someone else in a third-floor bathroom in the Denver area during the fourth quarter of the Nuggets-Lakers game on May 16, 2023.

In a lawsuit filed Thursday in Denver District Court, Kim says she was washing her hands when two drunken women approached her and asked if she was talking nonsense. When she said she wasn’t, the women began hitting her and pulling out her hair, the lawsuit said.

A male security guard responded to the attack but hesitated because it occurred in a women’s bathroom, causing Kim further harm, say Kim’s attorneys at the Wheat Ridge firm. Falgien Warr & Iyer wrote in the complaint.

Kim was diagnosed post-concussion syndromecommunication problems and other injuries resulting from the attack.

A female security guard would not have hesitated before entering the women’s restroom, the complaint alleges, and therefore would have responded more quickly to the attack.

“(Kroenke and Argus) acted unreasonably by failing to ensure adequate staffing, a proportionate number of male and female guards, adequate staff training and adequate staff pay throughout the Ball ArenaKim’s lawyers wrote in the lawsuit.

Representatives for Kroenke Sports & Entertainment did not respond to a request for comment Monday afternoon. Argus Event Staffing declined to comment on the lawsuit.
