RTD is facing a lawsuit after a commuter train collides and kills a cyclist

The Denver Regional Transporation District is facing a lawsuit after a commuter train struck and killed a cyclist last year.

The lawsuit was filed Thursday by Jacqueline Flores Razo after her husband Juan was killed in an accident involving an RTD A-Line train last July.

According to the complaint, Flores Razo’s man was riding his bicycle across the crosswalk of RTD’s Havana Crossing light rail station when a southbound train turned off its lights in front of a northbound train.

Once the northbound train passed, the southbound train passed through the station and crashed into Juan.

“The incident was caused by the negligent, careless and reckless operation of the RTD train,” the lawsuit said, adding that the train conductor “failed to exercise caution and care, including by failing to pay attention and causing the train cannot be properly controlled. Train tracks.”

The lawsuit alleges the RTD train conductor committed vehicular homicide, reckless driving and careless driving.
