A new public court filing revealed that Donald Trump’s lawyers allegedly found classified documents in his Mar-a-Lago bedroom four months after the FBI raid that led to his indictment.

The bombshell came from a 2023 opinion written by the U.S. District Judge Beryl Howell, who presided over the first grand jury in the case. Special counsel Jac SmithTrump’s team filed the filing ahead of arguments this week in response to Trump’s dismissal request.

Smith’s filing was intended to strengthen prosecutors’ argument that the former president knowingly concealed classified documents and attempted to hide them from the Justice Department.

If Politics Howell reported that prosecutors had presented compelling evidence that Trump committed the alleged crimes, adding: “Specifically, no excuse is given for how the former president could have missed the confidentially marked documents he kept in his own bedroom. Mar-a-Lago had found. .”

She alleged that the four pieces of classified material were discovered after Trump’s lawyers assured officials that all the classified material had been returned.

Next Wednesday, the prosecution and defense will present arguments on Trump’s request to dismiss the case.

The unsealed documents also include a series of photographs and detailed accounts of how Trump’s aides, among other things… Walt Nauta, allegedly moved boxes of classified material to evade detection. Nauta, who has been indicted along with Trump, is accused of lying to the FBI about his actions.

“In a footnote, Howell also noted that another Trump adviser affiliated with his Save America PAC had acknowledged scanning and storing the contents of the box containing the classified materials on a personal laptop belonging to the PAC in 2021,” Kyle reported Politico’s Cheney. .

The box containing the four documents was ultimately turned over to the FBI in January 2023, according to the judge’s ruling.

Trump’s legal team also used Howell’s opinion in arguing for the dismissal of the case, citing “prosecution misconduct.” Howell noted a specific instance in which a prosecutor inappropriately pressured another Trump attorney: Tim Parlatorebut clarified that this had limited relevance to the main issues at hand.

Wednesday’s proceedings will mark the first hearing related to the case since Trump appointed the judge Aileen Kanon postponed the case indefinitely, citing unresolved issues. The trial was scheduled to begin on May 20, but Judge Cannon recently hinted it might not begin until late summer or later, in line with Trump’s efforts to extend the proceedings beyond the 2024 election.

The former president faces 37 criminal charges for alleged misuse of hundreds of classified documents and obstruction of justice.

In January 2022, nearly a year after leaving office, he handed over boxes containing nearly 200 documents with classified markings, with more than 100 additional materials found during the FBI raid on his private resort in Palm Beach, Florida.
