Incumbent federal judge in Massachusetts appointed by Bill Clinton writes hit political piece on Justice Alito | The Gateway expert

In a disgusting violation of the code of ethics, a sitting federal judge wrote a political hit piece in the New York Times publicly attacking conservative Supreme Court Justice Samuel Alito.

U.S. District Judge Michael Ponsor, a Bill Clinton-appointed senior judge on the U.S. District Court for the District of Massachusetts, criticized Alito as he decides relevant pending cases.

The hit piece titled: “A Federal Judge Asks: How Could Alito Have Been So Foolish?” was published Friday, criticizing Alito for flying an upside-down flag at his home after the 2020 presidential election.

“Regardless of its legality, displaying the flag in that way should not have happened at the time. To put it bluntly, any judge with reasonable ethical instincts would have immediately realized that flying the flag was inappropriate at the time and in that manner. And stupid,” Judge Ponsor wrote.

“Like the upside-down flag, this flag is seen by many, many people as a banner of loyalty on partisan issues that are or could be before the court,” Judge Ponsor wrote.

“Raising those flags was tantamount to putting a ‘Stop the steal’ bumper sticker on your car. You just don’t do that,” the judge said.

“Before Judge Ponsor publicly lectures a Supreme Court justice on ethics and recusal issues in pending cases, he should probably check his own ethics,” said Mike Davis, Gorsuch’s former law clerk and president of The Article III Project.

“Canon 3A(6) of the Code of Conduct for Judges of the United States states: “A judge shall not comment publicly on the merits of a case pending or threatened in a court of law.”” – Davis said.

In March, U.S. District Judge Reggie Walton spoke publicly on CNN about pending legal cases.

Bush-appointed Judge Walton previously spoke to CNN’s Kaitlan Collins about threats he has received after calling Trump a “charlatan” and imposing excessive sentences on J6 defendants.

“I have had more threats than I used to,” the judge said, referring to a Jan. 6 case he oversaw.

Even Kaitlan Collins admitted that it is “rare that we hear from a sitting federal judge.”

Walton, a RESTINGING JUDGE, addressed Trump’s statements defending himself against Judge Merchan, his embattled daughter Loren Merchan and the latest silence order.

“It is very disturbing when someone makes comments about a judge, and it is especially problematic when those comments take the form of a threat, especially when they are directed at someone’s family,” Walton said. “We do this work because we are committed to the rule of law and believe in the rule of law, and the rule of law can only function effectively when we have judges who are willing to carry out their duties without the threat of potential physical harm.”
