Judge rejects Trump’s bid for a new trial against E. Jean Carroll

Trump’s attempt to get a new trial in the E. Jean Carroll case was not only rejected by Judge Kaplan. It was crushed.

Judge Lewis Kaplan wrote in his ruling:

Mr. Trump’s argument is completely without merit, both legally and factually, for all the reasons expressed in Ms. Carroll’s memorandum of law in opposition to his motion. It ignores, among other things, that: As the jury and/or the Court concluded, Mr. Trump’s June 21 and 22 statements were false, defamatory, and made with both actual and common law malice.

It ignores the fact that these defamatory statements have been viewed at least 85 to 104 million times, while there is no evidence whatsoever of the distribution of the article in The Cut to which the defendant seeks to attribute all the damages suffered by Ms. Carroll. which was not even alleged to be defamatory. It also ignores the fact that the jury was entitled to believe Ms. Carroll’s testimony about the impact of the June 21 and 22 statements on her. And it ignores the lack of any compelling legal authority supporting Trump’s claim. Indeed, the law is clear that when competing theories and evidence are presented at trial, the question of causation is ultimately a matter for the jury, which the Court should not normally disturb.

In short, the argument that Mr. Trump has made before the jury, conspicuously unsuccessful and contrary to common sense, does not deserve to be dismissed as a matter of law.

In case you’re wondering, Donald Trump is still trying to avoid paying E. Jean Carroll. Trump has not stopped in his efforts to have the verdict overturned or a new trial initiated.

The ex-president is doing everything he can to avoid paying E. Jean Carroll, and Judge Kaplan continues to slam the door on him.
