Legal experts suggest Trump could face a harsher sentence if convicted in Manhattan for his dozens of gag order violations.

The number of gag order violations Trump has officially committed stands at 10, but observers note there have been many more. Prosecutors are still monitoring Trump’s comments and could use them to argue for a harsher sentence if Trump is convicted.

‘Remorse and the need to promote respect for the law are usually factors that a judge takes into account when imposing sentences. Trump’s repeated violations of the silence order certainly demonstrate his lack of remorse and respect for the law,” McQuade said.

The elements working in Trump’s favor for a lighter sentence are that he is a first-time offender, almost 80 years old, and that his crimes, if convicted, were non-violent.

However, Trump’s attitude, behavior, lack of remorse and likelihood of reoffending are all factors that could lead to a harsher sentence.

If Trump is found guilty in Manhattan, the main outcome will be no prison time. It will be a misdemeanor conviction. The Republican Party will nominate a convicted felon as its nominee, and that could end Trump’s political career and any hope of victory in 2024.
